The National Do-Not-Call Registry became effective on October 1, 2003.
”FCC” Federal Communications Commission and “FTC” Federal Trade Commission Telemarketing Rules: Do Not Call, Do Not Fax
Residential and Commercial telephones are affected.
Even though the State of Indiana Do-Not Call Registry exempted real estate professionals, the National Do-Not Call Registry does not exempt real estate professionals except where the consumer called has agreed in writing to accept calls from the caller or where there is an “established business relationship.”
“Established Business Relationship” (EBR) is as follows:
1) Where the consumer has made a purchase, rental or lease of the seller’s goods or services or a financial transaction within 18 months preceding the call. (Example, if Brown Realty has a business transaction with a customer or client, Brown Realty has 18 months in which to freely contact the customer or client by phone or fax.)
OR
2) Where the consumer inquiry or application regarding a product or service offered by the seller is within the 3 months preceding call. (Example, when a consumer has called or faxed Brown Realty about an advertisement, Brown Realty has 3 months to freely contact the consumer by phone or fax.)
After these time limits, Brown Realty needs written consent to continue communication.
